Żminijietna criticizes the EU Cross Border Health Care Directive

Żminijietna – Voice of the Left acknowledges the fact that the approved legislation reached by a compromise in the European Parliament is to strike the right balance between guaranteeing patients’ rights to cross-border healthcare and providing safe quality health services at national level. In practice, Maltese patients waiting for an operation will be able to seek treatment anywhere in the EU and get a partial or full refund of the expenses from 2013. But on the other hand we are concerned as this will also enforce medical tourism across Europe .

We are of the opinion that any attempts in the future to liberalize more the health services in the European internal market, may lead to the dismantlement of public health services in each and every EU country. We question the real concept behind this directive if not to dismantle the rigid existing regulations in order to push forward the principle of free movement of services in the health services sector as originally stated by the European Court of Justice.

We are concerned that through this legislation, patients coming from richer countries will be able to travel to less expensive, may be poorer, countries where there will be a threat that care standards for locals will deteriorate to make room for profitable health tourism.

The principles of the free movement of services and the services directive which all were included in the new European Treaty will push forward medical tourism, and this, if not addressed continuously, will open the road to liberalization and privatization of health services across Europe.

Żminijietna – Voice of the Left would like to remind, that in the European Parliament, strong pressure to liberalize this sector is continuously being exerted. In December 2006 the Left group succeeded in gaining an important victory when health was excluded from the services directive. We fear that this legislation has made this obsolete.

Żminijietna – Leħen ix-Xellug tifhem li leġislazzjoni li ġiet approvata wara kompromess fil-Parlament Ewropew, hi biex iġġib l-aħjar bilanċ bejn id-dritt ta’ garanzija għall-pazjent li jmur ifittex kura f’pajjiż ieħor u li jiġi pprovdut servizz ta’ saħħa ta’ kwalita fuq bażi nazzjonali. Imma minn banda l-oħra aħna mħassbin li din ser tinforza wkoll it-turiżmu mediku madwar l-Ewropa.

Aħna ta’ l-opinjoni, li kwalunkwe attentat fil-futur biex jiġi l-liberaliżżat is-servizz tas-saħħa fis-suq intern Ewropew, jista’ jwassal għall-iżmantelliment tas-servizz tas-saħħa pubblika fil-pajjizi rispettivi ta’ l-Ewropa. Aħna nistaqsu x’inhu l-kunċett rejali wara din id-direttiva, jekk mhux li jiġu żmantellati r-regoli riġidi eżistendi sabiex jiġi mbuttat il-quddiem il-prinċipju tal-moviment ħieles tas-servizzi fil-qasam tas-saħħa, kif oriġinarjament lissnet il-Qorti Ewropeja tal-Ġustizzja.
  
Aħna mħassbin li b’din id-direttiva, pazjenti ġejjin minn pajjiżi sinjuri jkunu jistgħu jfittxu kura f’pajjiżi bi spejjez anqas għola, sa anka ifqar, fejn jista’ jkun hemm theddida li livell tal-kura fil-pajjiżi rispettivi jiddeterjoraw biex tagħmel tajjeb għal ‘turiżmu mediku profittabbli’.
Il-Prinċipju tal-moviment ħieles tas-servizzi u d-direttiva tas-servizzi li lkoll ġew inklużi fit-Trattat il-ġdid tal-Ewropa ser jimbuttaw il-quddiem it-turiżmu mediku, u dan jekk mhux indirizzat kontinwament, se jiftaħ it-triq għall-liberalizazzjoni u privatizazzjoni tas-servizzi tas-saħħa madwar l-Ewropa.

Żminijietna - Leħen ix-Xellug tixtieq tfakkar li kontinwament qed issir pressjoni fil-Parlament Ewropew sabiex jiġi liberalizzat dan is-settur. F’Diċembru ta’ 2006 il-grupp tax-Xellug rnexxilu jikseb rebħa mportanti peress li s-saħħa ġiet eskluża mid-direttiva tas-servizzi. Nibżghu li din il-leġislazzjoni ġabet din il-kisba fix-xejn.
