Press Release: Żminijietna supports the regularisation of prostitution

Żminijietna - Voice of the Left supports the Law Students Associations’ proposal for legislation to regulate prostitution, which entails making prostitution subject to employment and taxation laws.  Under Maltese law, it is illegal to force anyone into prostitution or to live off of earnings earned through prostitution. The law prohibits loitering and solicitation, as well as the forcing of minors into prostitution.

“For most persons, prostitution may not be a choice but a burden imposed by family ties or the need to sustain themselves in extraordinary situations, such as substance abuse. Others may find it hard to get proper employment due to poor levels of education and lack of skills. The entrance into prostitution increases exposure to higher health hazards and violence from pimps or clients. In other circumstances, women found culpable for a crime committed in the past leaves them with a criminal conduct that makes it hard for them to join the regular labour market”.

Żminijietna feels that the decriminalisation or legalisation of prostitution will be a step forward in the safeguarding of the health of those involved, as well as of their clients, by reducing the spread of sexually transmitted diseases through legal provisions for the use of contraceptives and other preventative measures.
“The regulation of prostitution would also help to ensure that all aspects of the health of sex workers and their clients are considered, whilst helping to keep any black market for the provision of sexual services, whether voluntarily or through coercion, to a minimum. Rather than being punished, women forced into such a lifestyle should be educated and led to gainful employment”.

Żminijietna – Leħen ix-Xellug tappoġġja l-proposta mressqa mil-Assoċjazzjoni ta’ l-Istudenti tal-Liġi fuq il-prostituzzjoni. Din tinvolvi li tagħmel il-prostituzzjoni suġġett għall-liġijiet tax-xogħol, u ta' tassazzjoni. Taħt il-liġi Maltija, huwa illegali li ġiegħel lil xi ħadd fil-prostituzzjoni u tgħix minn fuq il-qligħ mill-prostituzzjoni. Il-liġi tistipula li tlajjar u li tħajjir huwa llegali, kif ukoll l-infurzar ta’ minuri fil-prostituzzjoni.

“Għal ħafna persuni, il-prostituzzjoni ma hiex għażla tagħhom, iżda ta' spiss isibu ruħhom fiha permezz ta' rabtiet familjari, jew biex isostnu lilhom infushom bħal fil-każ ta' abbuż minn sustanzi ta’ droga. Oħrajn jistgħu jsibuha diffiċli biex jiksbu impjieg xieraq minħabba l-livell baxx ta' edukazzjoni u nuqqas ta' ħiliet bażiċi.Il-ħajja fil-prostituzzjoni iżżid ir-riskju ta' mard u espożizzjoni għal vjolenza minn min iħaddimhom jew il-klijenti stess. F'ċirkustanzi oħrajn, nisa misjuba ħatja ta’ offiża kriminali jispiċċaw b’kondotta maħmuġa li tagħmilha aktar diffiċli għal dawn in-nisa biex jiġu integrati fid-dinja tax-xogħol”.

Żminijietna temmen li d-dikriminalizazzjoni u legalizazzjoni tal-prostituzzjoni hija pass il-quddiem biex tissalvagwardja s-saħħa ta' dawk involuti, l-klijenti tagħhom, billi tnaqqas ir-riskju ta’ mard trasmess sesswalment b’liġi li tagħmel l-użu ta' kontraċettivi u miżuri oħra bħala neċessarju”.

“Ir-regolarizazzjoni tal-prostituzzjoni se tgħin wkoll biex tiżgura li s-saħħa u s-sigurtà ta’ dawk kollha nvoluti tiġi kkonsidrata, kif ukoll li l-ebda wieħed jew waħda ma tkun imġiegħla li taħdem . Aktar minn azzjoni kriminali, in-nisa nvoluti għandhom jiġu edukati u megħjuna jsibu mpjieg”.
